Do I have to pay stamp duty on a title change?

It depends on the change. A simple change of name generally doesn’t attract transfer duty, but transferring an interest in a property — for example, adding or removing an owner — often does. We’ll advise on what applies to your specific situation before anything is lodged.

I want to add my partner to the title — can you do that?

Yes. Adding a partner to a property title is a common request. Keep in mind it’s a transfer of an interest in the property, so transfer duty may apply, and if there’s a mortgage on the property your lender will usually need to be involved. We’ll walk you through what’s required.

What happens to the title when a co-owner passes away?

It depends on how the property was held. If it was held as joint tenants, ownership generally passes automatically to the surviving owner, and the title is updated by recording the death. If it was held as tenants in common, the deceased’s share passes through their estate. We can advise on your situation and handle the title update.

What’s the difference between joint tenants and tenants in common?

They’re two ways of co-owning property. Joint tenants own the whole property together, and if one owner dies their share automatically passes to the other. Tenants in common each own a defined share, which they can leave to whoever they choose. Changing between the two is something we can handle.

How long does a title change take?
